Ever heard of an interesting and maybe even outrageous story about an Armenian national in a Schengen country? Here’s one that happened to our client, whom we helped to successfully claim his violated rights.
So, our client, a citizen of Armenia got a single-entry Schengen C type Visa. After reaching the destination he passed the passport control and got an appropriate entry stamp in the passport. The same day, after the planned flight to another Schengen country, for unclearreasons our client got an exit stamp from Schengen area in the passport, without being priorly informed about that. After the arrival at the destination, he got a rejection alert to entry to the country on the ground that the immigration officers in the first destination airport put exit stamp from Schengen area, clearly knowing from the presented flight ticket and boarding pass that the flight is directly to another Schengen member country. Consequently, the actions of our client were considered as illegal entry to the country and the latter was penalized and deported from the country.
After investigating his case, we found out that the improper actions of immigration authorities caused impossibility for our client to enter his destination country. Respective Schengen legislation allows a “single entry” visa holder to travel freely within the zone. Undoubtedly, this incident could have had irreversible consequences for the client, included obstacles for getting any visa in the future.
We are happy that one of our dedicated and fearless attorneys Anna Mkrtchyan managed to eliminate all the potential negative consequences with the help of the constructive work and support of relevant authorities of Schengen countries. Constant correspondence and communication with the state authorities gave us the following results:
• All the criminal proceedings initiated against our client were discontinued;
• We got an official letter from the authorities on the withdrawal of the residence measures;
• The refund of the penalties is currently in process.
